Farm management skills
Applicants must prove that they have farm management skills.Proof of this may include, but is not limited to:
Sufficient financial resources
Applicants must be able to invest a minimum of CDN $500,000 of equity in a primary production farming business.Documents must be provided that show a minimum net worth of CDN $500,000 or confirmation of the ability to access to a similar amount of funds from other sources.Applicants may be required to show the ability to invest more than the minimum.
The following individuals are not eligible::
refugee claimants, or individuals involved in a federal appeal or removal process.

Entrepreneurs may apply under the general provision if they
· are currently employed by a multi-national company and seeking entry to work in a
parent, a subsidiary, a branch, or an affiliate of that enterprise.
· are transferring to an enterprise that has a qualifying relationship with the enterprise in which they are currently employed, and will be undertaking employment at a legitimate and continuing establishment of that company (where 18–24 months can be used as a reasonable minimum guideline);
· are being transferred to a position in an executive, senior managerial, or specialized knowledge capacity.
· have been employed continuously (via payroll or by contract directly with the company), by the company that plans to transfer them outside Canada in a similar full-time position (not accumulated part-time) for at least one year in the three-year period immediately preceding the date of initial application. Extensions may be granted up to the five- and seven-year maximums. Documented time spent outside Canada during the duration of the work permit can be “recaptured” to allow the company transferee five or seven full years of physical presence in Canada.
· Generally, the company must secure physical premises to house the Canadian operation, particularly in the case of specialized knowledge. However, in specific cases involving senior managers or executives, it would be acceptable that the address of the new start-up not yet be secured; for example, the company may use its counsel’s address until the executive can purchase or lease a premise.
· The company must furnish realistic plans to staff the new operation.
· The company must have the financial ability to commence business in Canada and compensate employees.
· When transferring executives or managers, the company must demonstrate that it will be large enough to support executive or management function.
· When transferring a specialized knowledge worker, the company must demonstrate that it is expected to be doing business; ensure that work is guided and directed by management at the Canadian operation.
· Initial work permit: one year
· For renewals, evidence should be provided that the Canadian and foreign companies still have a qualifying relationship; the new office has engaged in the continuous provision of goods or services for the past year; the new office has been staffed.
The following documentation is required:
· confirmation that the foreign national is currently employed by a multi-national enterprise outside Canada, and seeking entry to work in a parent, subsidiary, branch, or affiliate of that enterprise in Canada;
· confirmation that the foreign national has been employed (via payroll or by contract) continuously (full-time, not accumulated part-time) by the enterprise outside Canada, in a similar full-time position, for at least one year within the three-year period immediately preceding the date of initial application;
· outline of the applicant’s position in an executive or managerial capacity or one involving specialized knowledge (i.e. position, title, place in the organization, job description);
· in the case of “specialized knowledge”, evidence that the person has such knowledge
and that the position in Canada requires such knowledge;
· outline of the position in Canada (namely, position, title, place in the organization, job description);
· indication of intended duration of stay; and
· description of the relationship between the enterprise in Canada and the enterprise in the foreign country (the officer may request tangible proof to establish the relationship between the Canadian and foreign organization wishing to make the transfer).
Normally, the duration of the work permit will be used to calculate the maximum five- or seven-year time limit. However, documented time spent not working—either inside or outside Canada—during the duration of the work permit can be “recaptured” to allow the company transferee five or seven full years of physical presence in Canada.
For example, if an transferee senior manager has a work permit for 1 year and spends 2-month stints over the course of the 12 months working in the United States, then only 8 months would count against their 7-year limit as an company transferee.
Note: Recapture will not be considered for any time periods of less than 30 consecutive days.
After transferees have reached their maximum work permit duration (seven years for executives and senior managers, and five years for specialized knowledge workers), they must complete one year of full-time employment in the company outside Canada if they wish to re-apply as an -company transferee
Employees who have worked for the company for at least one year on a full-time basis, and hold specialized knowledge or an executive or managerial position may qualify.
Executives who perform direct management or major components and functions of the business, while receiving only general supervision or direction from other executives, directors or shareholders.
Managers who supervise and control the work of other managers or supervisors, and/or manage essential functions within the business or a division.
People with specialized knowledge, where the individual must have proprietary knowledge and advanced expertise of the company’s product or service.
Documents which prove the foreign worker has been employed, and is currently employed, as a full-time employee at the company for at least one year.

The company transfer processing time in Canada can be completed quickly in 1 month or as long as 12 months, it depends on the country the applicant applies from.
Question: Can I change employers while in Canada on an -company transferee? Answer: No, this program is employer specific. If your employment with the company ended you would need to leave Canada, unless you qualified and applied for another visa.
Question: What is the maximum duration for company transferees?
Answer: Seven years for executives and senior managers, and five years for specialized knowledge workers. Once the maximum time is reached, they will need to complete one year of full-time employment outside of Canada , and are required of NAFTA to reapply for company transfer.
Question: May I request an Company Transferee for my spouse?
Answer: Spouses and children are permitted to live in Canada as part of company transferee program.
Question: What specialized knowledge qualifies for transfer?
Answer: Someone with insight on intellectual property the company owns. Based on our experience, it’s very common for tech workers to fall into this category.
Question: What are the requirements if the company is start-up?
Answer: It can be complicated, and we recommend speaking to our intra-company transfer lawyers. To determine transferee eligibility, the company must have proof of financial ability and a plan for growth in Canada. The initial work permit is one year.
Transferees are often in a strong position to become permanent residents of Canada, should they wish to do so. Permanent residents can reside and work in any location in Canada.
There may also be options to transition to permanent residence outside the Express Entry system, such as through one of the Provincial Nominee Programs (PNPs).
Ultimately, some people who begin working in Canada as company transferees may become naturalized Canadian citizens. This step comes after the granting of permanent residence.
